TERMS AND CONDITIONS FOR PRIZE DRAWS



PROMOTER: NATIONAL GEOGRAPHIC CHANNEL

By entering the prize draws and clicking the submit button, all entrants are deemed to have accepted and agreed to abide by these terms and conditions.

Entrants
1.Entry into all monthly prize draws including the grand prize draw is open to individuals who are at least the age of majority in their jurisdiction of residence who have residency in one of the following countries: Australia, France, Germany, India (excluding any states in India where such contests are not permitted under applicable law), the Netherlands, the United Kingdom and the US.
2.Employees of National Geographic Channel ("NGC") and its parent, subsidiary and affiliated companies, and each of their respective officers, directors and employees (collectively, the "NGC Entities"), and members of their families and/or those living in the same household of each, are not eligible to enter.
3.Entrants can enter the prize draws only as specified in these terms and conditions and the online entry form.
4.Winners will be expected to provide NGC with the form of proof of identity as NGC in its sole discretion requests.
5.Failure to comply with any of these terms and conditions will disqualify any entrant from being included in a draw or from being awarded a prize (as the case may be).
6.NGC reserves the right to amend these terms and conditions in the event of a change of circumstances outside of its control.
Entry to and making of the Monthly Prize Draws
7.There are 4 separate monthly prize draws. To enter a monthly prize draw, entrants must fill in the relevant online entry form with their name, location, email address and telephone number and correctly answer the question that is posed. The online entry form is located on the National Geographic Channel website local to the entrant’s country of residence, which for the purpose of Australia is www.nationalgeographic.com.au/, for the purpose of France is www.ngcfrance.tv/, for the purpose of Germany is ngchannel.de, for the purpose of India is www.nationalgeographic.co.in/, for the purpose of the Netherlands is /www.ngc.tv/, for the purpose of the UK is natgeochannel.co.uk/ and for the purpose of the US is www.nationalgeographic.com/channel/. Only those entrants who correctly answer the question that is posed will be eligible for the monthly prize draws. Entries can only be made online. No other form of entry will be accepted.
8.No payment or subscription to NGC, or other purchase, is necessary for entry in the monthly prize draws save for the entrant’s internet connection fee.
9.Any entry made giving another person's (or a false) name will be disqualified.
10.The prize draws open on 10th March 2008 and close at midnight (local time in the entrant’s country of residence) on 9th July 2008. Specifically, the 4 separate monthly prize draws will respectively open on the 10th day of each of the months March, April, May and June 2008 and will respectively close on the 9th day of each of the months April, May, June and July 2008. Entry into the monthly prize draws must be received by midnight (local time in the entrant’s country of residence) on the 9th day of each of the months April, May, June and July 2008, respectively. Monthly prize draws will be made on 15th April, 14th May, 13th June and 15th July 2008, respectively, at 3pm local time in the place of draw, being the offices of belong Pty Ltd, Level 8, 155 George Street, Sydney NSW 2000, Australia (the “Place of Draw”). The winner of each of the monthly prizes will be chosen at random from those correct entries that comply with these terms and conditions and have been received before midnight (local time in the entrant’s country of residence) on the closing date stipulated for the relevant monthly prize draw. Each winner will be notified in writing by email or letter within 2 days of the draw date and may additionally be notified by telephone. Each winner will also be announced online and, in accordance with local Australian rules, each winner’s details will be published in the public notices section of a nation-wide Australian newspaper called the Australian.
Entry to and making of the Grand Prize Draw
11.By entering any one of the 4 monthly prize draws, entrants who correctly answer the question that is posed for that monthly prize draw, will in addition be automatically included in the grand prize draw. Accordingly the grand prize draw is open on 10th March 2008 and closes at midnight (local time in the entrant’s country of residence) 9th July 2008. The winner of the grand prize draw will be chosen at random from those correct entries to any one of the monthly prize draws that comply with these terms and conditions and have been received before midnight (local time in the entrant’s country of residence) on the closing date stipulated for the relevant monthly prize draw.
12.The winner of the grand prize draw will be notified in writing by email or letter within 2 days of the draw date and may additionally be notified by telephone. The winner will also be announced online and, in accordance with local rules, the winner’s details will be published in the public notices section of the Australian, a nation-wide Australian newspaper.
13.The draw for the grand prize will take place on 18th July 2008 at 3pm local time in the Place of Draw.
The Prizes
14.One (1) grand prize is available. The grand prize which is valued at R 100,000 (AUD 15,000 exclusive GST; USD 13,500) will consist of a 10 day trip for winner and one (1) guest in South Africa to be taken within 6 months of the prize draw date but not during local South African school holiday months being April and June and not during peak season months being December and January. The trip will be an organised tour and will include two return economy fares from an international hub in the winner’s country of residence, transfers in South Africa, 9 nights’ accommodation on a bed and breakfast basis and 7 lunch and 6 evening meals. The accommodation will have a minimum rating of three stars. The prize excludes passport and visa expenses, if any, as well as travel insurance and personal expenses.

The grand prize winner’s travel companion must be at least the age of majority in his/her jurisdiction of residence, or if the travel companion is a minor, such companion may only travel with the written permission of his/her parent or legal guardian in form and substance acceptable to NGC in its sole and absolute discretion. Grand prize winner and his/her guest must travel together on the same itinerary and possess all required travel documents, including visas and valid passports, if and as applicable. Air transportation does not include government taxes, passenger facility charges or related fees. Air transportation tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. All air transportation tickets are subject to the vagaries of flight variation, work stoppages and schedule or route changes. Approximate retail value for travel prizes may vary depending upon points of departure and destination and fare fluctuations. If the closest airport to the grand prize winner’s home is in close enough proximity to prize destination city so that, as NGC may determine in its sole discretion, a flight is unnecessary, such prize winner will receive alternate transportation from NGC with no further obligation to the winner. Grand prize winner will not receive cash or any other form of compensation if actual travel costs are less than the stated approximate retail value. NGC reserves the right to structure the travel route and select hotels in its sole discretion.
15.The prize for each of the 4 monthly draws will be a hamper valued at R 1,000 (AUD 150 exclusive GST; USD 135) which will consist of a South Africa Tourism coffee table book, a ladies pendant, a wine cooler and two CDs.
16.Where prizes are unclaimed, (and in accordance with local rules in Australia, subject to any written direction given under regulation 37 of the Lotteries and Gaming Act 1993 (SA) where applicable), an unclaimed prize draw will take place at the Place of Draw 3 ½ months after the original applicable draw date at 3pm local time in the Place of Draw, as follows: in the event that the grand prize is not claimed an unclaimed prize draw will take place on 3rd November 2008; in the event that a prize from the first monthly prize draw remains unclaimed, the unclaimed prize draw will take place on 30th July 2008; in the event that the prize from the second monthly prize draw remains unclaimed, the unclaimed prize draw will take place on 29th August 2008; in the event that the prize from the third monthly prize draw remains unclaimed, the unclaimed prize draw will take place on 29th September 2008; in the event that the prize from the fourth monthly prize draw remains unclaimed, the unclaimed prize draw will take place on 30th October 2008. Any winner of an unclaimed prize draw will be notified in writing by email or letter within 2 days of the unclaimed prize draw date and may additionally be notified by telephone and will also be announced online and, in accordance with local rules, the winner’s details will be published in the public notices section of the Australian, a nation-wide Australian newspaper
17.The odds of winning a prize depend on the total number of eligible entries received for that prize draw.
18.The prizes will be as set out in these terms and conditions and the entry form and the winners must accept their prizes in that form. Under no circumstances will cash be given as an alternative. The prizes are non-refundable and cannot be transferred. NGC retains the right to substitute a prize of comparable or greater value in the event a stated prize is unavailable, in whole or in part, for any reason.
19.Winners will be liable for any surcharges that may be levied on a prize and for any expenses not specified in the description of the prize.
20.All taxes (including, without limitation, federal, state, and local taxes) on or connected with any prize, and the reporting consequences thereof, are solely the responsibility of respective winners. If required by law, NGC reserves the right to withhold and remit to the appropriate taxing authorities the amount of any taxes due. With respect to non-cash prizes: (i) for the purpose of any winner resident in the US it may be necessary under the US Internal Revenue Code (as determined by NGC in its sole discretion) for the prize winner to pay the amount of any tax before receiving the prize; (ii) for the purpose of any winner resident in India, the taxes and surcharges include but are not limited to the TDS on prize winnings as prescribed under section 194 of The Indian Income Tax Act of 1961 (as amended) that may be levied either at present or in the future on the value of the prize and the winner will only be eligible to claim the Prize once he/she produces to the Company the physical proof of having deposited the applicable TDS evidenced through an original challan /certificate on the value of the prize; and (iii) for the purpose of any winner resident in any of the other territories listed in Part 1 of these terms and conditions it may be necessary under any applicable legislation (as determined by NGC in its sole discretion) for the prize winner to pay the amount of any tax before receiving the prize.
21.Prizes (or documentation relating thereto) will be sent to the home address of the winners as specified in the entry form. In the event that a prize or a prize notification does not reach an addressee for reasons beyond its control, NGC shall not be liable.
22.In the event a potential Grand Prize winner is a U.S. resident, the potential Grand Prize winner will be required to execute an Affidavit of Eligibility, a Liability Release, a Publicity Release (where imposing such condition is legal) and any other applicable forms required by tax authorities and NGC (collectively, “Prize Claim Documents”). If such potential Grand Prize winner fails or refuses to sign and return all Prize Claim Documents within seven (7) days of prize notification (or a shorter time if required by exigencies), the potential Grand Prize winner, may be disqualified and an alternate may be selected.
Publicity and Personal Data
23.All personal data submitted by an entrant in connection with a prize draw is submitted voluntarily. All personal data collected from the entrants will be used by NGC for the purpose of administering the prize draws and will be added to a database owned by NGC for use in marketing, sales and promotions of the National Geographic Channel in accordance with permission granted or withheld as applicable on the online entry form. Further information about how NGC holds information gathered through its website is available from its privacy policy. 24.Subject to the separate consent of entrants, personal data will also be transferred to South African Tourism in South Africa. South African Tourism shall use it for the purpose of sending entrants an invitation to sign-up to receive its monthly newsletter but for no other purpose. You should be aware that South Africa does not have a data protection law in place, but that South African Tourism complies with US and UK data protection standards.
25.Other than as stated above, no personal data will be transferred to any other third party. An entrant may demand access to their personal data held by NGC and may require correction or deletion of such data by written request to NGC.

By entering the prize draws, the winners agree to the use of their name or likeness, without compensation, for promotional purposes worldwide, and in all forms of media now known or hereafter developed, in perpetuity, unless prohibited by law. NGC intends to publicise the winner of the grand prize on the National Geographic Channel. The winner of the grand prize will be expected to take part in any public relations activity reasonably requested by NGC.

Miscellaneous
26.NGC entities shall not be responsible or liable for any losses, damages or injuries of any kind resulting from participation in the prize draws or in any prize draw related activity, or from a winner's acceptance, receipt, possession and/or use or misuse of any prize. Each entrant, by submitting their entry, expressly releases NGC entities from any claim (other than that arising from death or personal injury caused by the negligence of NGC), action or demand arising out of or in connection with a prize draw or use or acceptance of any prize.
27.The prize draws are governed by the laws of England.
28.These terms and conditions, the entry form and the instructions for completion of the entry form (all of which are contained on the National Geographic Channel website local to the entrant’s country of residence, which for the purpose of Australia is www.nationalgeographic.com.au/ , for the purpose of France is www.ngcfrance.tv/ , for the purpose of Germany is ngchannel.de , for the purpose of India is www.nationalgeographic.co.in/ , for the purpose of the Netherlands is www.ngc.tv/ , for the purpose of the UK is natgeochannel.co.uk/ and for the purpose of the US is www.nationalgeographic.com/channel/) comprise the total information relating to the prize draws. United States residents may request any legally required winner's list by sending a self-addressed stamped envelope to: National Geographic Channel Prize Draw Winner's List, Vincent D’Ambra, National Geographic Channel, 1145 17th Street, N.W Washington DC 20036, US. All such requests must be received within six (6) weeks after the end of the closing date.
